Acceptable Use Policy

The use of the Glartek Software (as defined in the Glartek Terms of Use) is subject to this Acceptable Use Policy. You agree not to, and not to allow third parties (including any of your authorized users) to, do any of the following in connection with the Glartek Software: 

 

  • violate, or encourage the violation of, the legal rights of others (for example, this may include allowing authorized users to infringe or misappropriate the intellectual property rights of others); 
  • violate any law, statute, or regulation in any jurisdiction where you or your authorized users use the Glartek Software; 
  • upload or share any content that is obscene, vulgar, pornographic or indecent, or that contains, promotes, or encourages acts of violence, terrorist activity, or child exploitation; 
  • advocate bigotry, hatred, or harassment of any person or group, including Glartek personnel or representatives; 
  • engage in, promote or encourage illegal activity; 
  • carry out any unlawful, immoral, invasive, infringing, defamatory, or fraudulent purpose (for example, this may include phishing, creating a pyramid scheme, or mirroring a website); 
  • intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature; 
  • interfere with the use of the Glartek Software, or the equipment used to provide the Glartek Software, by customers, authorized resellers, or other authorized users (for example, by overloading or flooding any part of the Services); 
  • tamper with, reverse engineer, hack, disable, interfere with or circumvent any aspect of the Glartek Software or any security or authentication measures; 
  • access or obtain a copy of the source code of the Glartek Software; 
  • adapt, translate, change, customize, enhance, partially delete, alter or otherwise modify the Glartek Software in any manner or to any extent whatsoever other than as contemplated in a separate written agreement with Glartek; 
  • attempt to gain unauthorized access to the Glartek Software; 
  • probe, scan, or test the vulnerability of any system or network, unless done in accordance with the written consent of Glartek; 
  • avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Glartek or any other third party to protect the Glartek Software; 
  • generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisings or other solicitations; 
  • access, tamper with, or use parts of the Glartek Software, or shared areas of the Glartek Software, to which you have not been invited; 
  • share, transfer or otherwise provide access to an account designated for a specific authorized user / named person to another person; 
  • access, search, or create accounts by any means other than our publicly supported interfaces (for example, “scraping” or creating accounts in bulk); 
  • overwhelm or attempt to overwhelm infrastructure by imposing an unreasonably large load on the Glartek Software that consume extraordinary resources, such as by: (i) using “robots,” “spiders,” “offline readers” or other automated systems to send more request messages to our servers than a human could reasonably send in the same period of time using a normal browser; or (ii) going far beyond the use parameters for the Glartek Software; 
  • attempt to access or search the Glartek Software or download content from the Glartek Software using any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than as specifically permitted by Glartek through integrated third-party product or service or other generally available third party web browsers; 
  • use the Glartek Software Application Programming Interfaces (API) in an unresponsible manner (e.g., abusive number of calls, unsupported calls, unauthorized endpoints or affecting negatively the performance of the API); 
  • violate the privacy of others, or to collect or gather other users’ personal information (including account information); 
  • access or use Glartek Software in a United States embargoed country or in violation of any applicable export law or regulation (including any United States export laws and regulations); 
  • provide, disclose, lease, distribute, sublicense, sell or otherwise commercially exploit the Glartek Software and documentation or make the Glartek Software and documentation available to a third party other than as contemplated in a separate written agreement with Glartek; 
  • access the Glartek Software and documentation in order to build a similar or competitive product or service or copy any ideas, features, functions, brand, trademark, or graphics related to the Glartek Software; 
  • access the Glartek Software for the purpose of monitoring availability, performance or functionality, or for any other benchmarking or competitive purposes, other than as contemplated in a separate written agreement with Glartek; 
  • use any non-production environment for production purposes; 
  • solicit any authorized users of Glartek Software for commercial purposes; 

 

You agree to the following in connection with the Glartek Software: 

  • promptly notify Glartek if any illegal or unauthorized activity or a security breach involving Customer accounts is discovered, including any loss, theft, unauthorized disclosure, or use of login credentials; 
  • give designed Glartek employees access to the Glartek Software for Customer support requests or if required. 

 

Violation of this Agreement

The restrictions set forth in this Acceptable Use Policy apply regardless of your intent and whether or not you act intentionally or unintentionally. 

 Glartek reserves the right to investigate any violation of this Acceptable Use Policy and may: 

  • investigate violations of this Acceptable Use Policy or misuse of the applicable Glartek Software; 
  • remove, disable access to, or modify any material, content or resource that violates this. 

Discolsure

Glartek may disclose information regarding the use of the Glartek Software to satisfy any law, regulation, government request, court order, subpoena or other legal process. If we make this type of required disclosure we will notify you, unless we are required to keep the disclosure confidential. 

 Glartek also may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third party. 

Trademark

Unless you have our express prior written permission, you may not use any name, logo, tagline or other mark of ours or the Glartek Software, or any identifier or tag generated by the Glartek Software, including without limitation: (a) as a hypertext link to any website or other location (except as provided for or enabled expressly by us); or (b) to imply identification or partnership with us, certification or endorsement by us, or your role in any other representative capacity with respect to us. You also agree not to remove or alter any of these items as we may have provided or enabled.
